EMAS and the IPPC process

About this good practice
The regulatory relief is specified in the Act No. 76/2002 on Integrated Prevention and in the providing document - the Regulation No. 288/2013 – Implementation of the Directive 96/61/CE on the integrated prevention and reduction of pollution (IPPC Directive), and Industrial emission directive 2010/75/EU.
a) Act No. 76/2002, § 20b - Inspection
In the systematic assessment of environmental risks is always considered -
the participation of the facility operator in the Community Eco-Management and Audit Scheme (EMAS) or other environmental management system.
It means that the Czech Environmental Inspectorate take into account that the enterprise with EMAS have minimalized potential environmental risk.
b) Regulation No. 288/2013, § 4 - Content of the application
The enterprises which are obliged to have an Integrated Environmental Permit can benefit in the application process.
Reports and documents provided for ISO14001 and EMAS certification can be attached to the application for Integrated Environmental Permit, to fullfill BAT 1. However, they are considered as additional documents only.

Resources needed
Since the measure is the implementation of the IPPC Directive, it doesn't require high costs. Only costs are the human resources within the legislation process.
Evidence of success
Althought the measure is included in the very important act, the achieved results are not clear, because no evidence is provided by the competent bodies related to the application assement and the environmental inspection process. This measure is considered as the support measure, in fact when the enterprises (which are obliged to have an integrated permit) are burdened with many administrative and reporting obligations.
Potential for learning or transfer
This regulatory relief was adopted as an implementation of the IPPC Directive. Since the EU generates many directives which need to be implemented by EU member states, we see the potential of implementing the environmental management systems such an EMAS, where is relevant.
This measure is set such as non-financial support, it means it is well feasible.
